I do not know what common law principle applies in New Zealand - I assume the English one. In South Africa the much more advanced legal common law system - the Roman Dutch system - is applied. This system depends on indisputable proof that an offence has been committed and also that if there is any doubt the accused is afforded the benefit.
There is absolutely no certainty that an offence has been committed and if so - there can be no charges in such a case - hence no action been taken against Jannie. It will serve no purpose to make all kind of wild statements - unless you are just needling.
Beeno (aka it's the refs fault ) : just applying simple logic one arrives at the inescapable conclusion the Boks & other teams (not ABs of course ) are getting special treatment. I present the big picture facts below in the sprit of helpfulness:
If you have a team that is so superior the powers that be have to help the weaker nations, e.g. South Africa; the Poms, Ozzies, etc. It is in the interest of the sport.
The Mighty All Blacks even did this in the last RWC where we let the French think they were doing well - ultimately we of course won the game but we kept in close & believe that the sport has benefited from this generosity.
We (not wee Beeno, lol) All Black fans also go along with this very fair-minded good sport type of approach and indulge the friendly but mindless chatter about refs and cheating, etc. This is very evident on this site for example.
You are a fair-minded and intelligent fellow Beeno so although this is a hard truth I am sure you can see the logic and will arrive at the same conclusion.

A case of the pot calling the kettle black? Better keep quiet about dirty play unless you are sure that the All Blacks are squeaky clean - which they are not. The latest two warranted red cards in Tests and Super Rugby was given against Hore and Nonu - the one against Bismarck was eliminated because it was a referee mistake.
At least when a SA player disgraces himself and the team - there is an apology made by our coach - when an All Black does the same Hansen says nothing and apparently condones it. If there is something unacceptable - that is.

And the only shame about the RWC Final was that it wasn't the Ockers we were thrashing.....we'd already done that in the Semi!
