I accept the verdict like any good Shark supporter should - and am delighted.   However, was the contact accidental?   Like was the Zimbabwe Election Results rigging accidental?

Whilst looking at the incident - I did not think it was accidental - but you can expect anything from lawyers - remember Saffex is also a lawyer.

they have made their decision regarding Bismarck , I will see if I can find the "incident" to see what is acceptable in the minds of the authorities .If Bismarck did get away with misbehaving it won't help him as he will keep repeating it & not learning. Eventually it will really cost his team.

pretty bullshit that bizzy got away with it.

he was clearly fudged of with that cheetahs player and retaliated with a deliberate stomp.

at least bizzy is on the right end of a bull shit call this time, and cosmic rugby balance is now restored in the house of du plessis,

Moz we are in a difficult spot here. This was an atrocious decision of nz proportions!!However we do want to beat the guppies at full strength lest we have rooitwit, ou maaaikie and sharkbok and co making excuses for the rest of the year. The reactions of the guppeis to this maladminmistration of justice is also worthy of note. It would appear their scruples are moved by every change of the wind - ala nz oaks. Are they suffering from a bad example one wonders?
Ex Sport 24:Cape Town - Sharks hooker Bismarck du Plessis has been cleared to play in the Currie Cup final against Western Province on Saturday after being found NOTguilty of a stamp on Free State Cheetahs flank Lappies Labuschagné in their semi-final in Durban last weekend.

CLICK HERE TO WATCH BISMARCK DU PLESSIS STAMP ON LAPPIES LABUSCHAGNE

Outrage at advocate André Oosthuizen's decision to clear Du Plessis has been rife since his decision was made public earlier on Tuesday.

Oosthuizen ruled that based on the facts placed before him by the player and the assistant referee Cobus Wessels, as well as the video footage viewed during the enquiry, the contact Du Plessis made with Labuschagné was ACCIDENTAL.

Looking at replays of the incident it's impossible to believe the incident was accidental. Du Plessis initially attempts to punch/slap Labuschagné, but his efforts are blocked. He then stands up, looks directly at the prone Labuschagné and stamps on his chest - ALL the while with direct eye contact on the player.

Du Plessis received a yellow card in the 65th minute of the match for the incident - a match the Sharks were well on the way to winning.

Du Plessis' clearing will go a long way to helping the Sharks regain the Currie Cup title.

Earlier this season, WP flank Michael Rhodes was red-carded AND banned for one week for asimilar offence.

SuperSport scribe Brenden Nel was quick to offer his views on Twitter.

While it is good for the final and the contest you have to wonder why we always are aggrieved at sanzar and irb judiciaries.

We sweep these matters under the carpet - like schalk vd merwe last week - when the irb and sanzar are less lenient.

I like Bismarck but to say that was accidental is a bit of a joke. Whether it breached the red card threshold is what the real question

Respected journalist Gary Lemke also weighed in.

Bismarck cleared to play CC final. imagine the SA outcry if McCaw had stamped a Bok and been cleared to play again the next week

You get a sense Saru were undone by the occasion. in a "normal" week they would have suspended him

SA Rugby mag's Jon Cardinelli even went as far to put his thoughts into a column...

Sport24 readers were also outraged by the decision.

How can Advocate André Oosthuizen reserve his judgment for another day when he knew exactly what his finding would be. Bismarck got a yellow based on the findings of the match referee and was cited for further punishment. Based on the video evidence, just like Michael Rhodes, I don’t think the intent is to injure an opposing player but nevertheless Michael got a week and Bismarck gets no further punishment. That smacks of being biased and clearly not the same law being applied. All rugby loving people should get a petition to get these type of offences to be put through a panel and not just an individual who has clearly been pressurized for his decision. Tired of bullshit. - Jose Henriques

Why was Michael Rhodes red carded - what was the difference? Has this something to do with the Curry Cup Final match? I dont think this is fair and  what about being consistent. -Jeanette Lubbe

The Bismarck stamping incident may have been accidental, but I feel that the SARU judicial committees should be consistent when they make decisions. In Micheal Rhodes’ case the judicial officer, Peter Ingwersen, ruled that although there was no intent by Rhodes to stamp on the side of Ross’ face as he was being pulled down in a tackle at the time and tried to regain his balance, there was sufficient negligence to find the player guilty of transgressing Law 10.4 (b). The law states that a player may not stamp on an opponent. In both instances there were stamping, and in both instances there were no intention to stamp on the opponent. Why should Bismarck be treated differently than Rhodes? Stamping is stamping. - Leon Marais

HE CAN COUNT HIMSELF VERY VERY LUCKY !!! - Marietjie

Unfair just bc his a bok he can stamp on someone an gets away with it.micheal rhodes got a red card an was banned for the same thing. - deond8

While lying on the ground Bismark tried to hit Freestate player with knee and missed and when he got up it eas very clear that he stamp on the player on the ground. - spandauspar

This is just another example of how cynical things have become in 2013. There was only one decision....a red card on the field . But given the officials chickened out and gave a yellow, a ban for several weeks was the minimum that was decent.

The man who made this decision has just let down sport in South Africa.

Looking at the incident as a whole - there were three actions in play, namely -

1.    Labuscgane tackled Bismarck - a perfectly legitimate play;

2.    Birmarck took a swipe t Labuschagne - whom the latter blocked with his forearm; and

3     Bismarck got up and was standing when he stamped Labuschagne in the chest area.

Taking together the swipe and the stamp incident I do believe there was a real intent to take revenge on Labuschagne for the tackle.   There was no real reason while Bismarck in a standing position needed to step onto the chest of Labuschagne - he was not off balance.

The decision to my mind stemmed from actions higher up with some pressure on Oosthuizen to ensure that Bismarck is not banned for three or four future matches - inclusive of the CC Final and the EOYT.   That such pressure result in a real breach of the laws of rugby - is just not acceptable.

In any event I hope that despite the ruling of Oosthuizen - Bismarck have been  told by his coach that is conduct in this case was disgusting and will not be tolerated in future.

He really like Mozart said disappointed a lot of people - me included - who stood by him in the Carter incident.    We do not need another Bakkies Botha around.

Bizzy fk'd up and the judicial officer was swayed purely by the fact that its a Currie Cup final. Some will love him (Sharks supporters and neutrals), some will hate him (WP supporters).

The neutrals just want to see a good game. Sharks have it all to do as WP are unbeaten this year and at home. We need all our stars out there.

Doesn't make the decision the right one but nonetheless, WP can turn their attentions away from the hearing and start preparing to meet a Sharks front row with Bizzy in it.

I read a comment above that says Rhodes stepped on Ross' face? I take it Ross Cronje. That is a little different to stepping on a chest dont you reckon?

Bizzy needs to realise he is a far better player than this. As he showed in the Carter hit, he can be strong and intimidating in a legal way. He doesn't need to become this brut meat head with silly off the ball crap! He has a pretty good rep world wide (except NZL because those little bitches cry about everything against their own players but quickly forget their own transgressions) and he doesn't need to change that perception of him now!

Anyway, whether it is the wrong or right decision, we have a decision nonetheless and Bizzy is playing so lets hope for a cracker final and hope that WP can make a game of it. I dont wana see the Sharks get up and coast ;-)

....but you've also exposed how corrupt rugby is in South Africa at the highest level by sweeping a blatant stomping incident under the carpet like that....oh the shame...hang your head Brother Bueno, give me 50 Hail Marys then go away and sin no more...lol

Mike, what do you mean stood by him for the whole "Carter incident?" The whole rugby world including IRB saw no incident worthy of a player being in trouble there. Just fair hard player.

Even 90% of the kiwi's realise there was no "incident" there. Only the kiwi okes on this board dont realise this but then again, these are the same okes that think their players are gods and have never committed foul play or dabbled in performance enhancers. That only happens in every other country in the world. Not NZL.

Bismarck fk'd up in a stupid act of foul play and he should have been punished but he wasn't. I am sure there were influences around this decision and the unfortunate thing is this judicial officer will now have to explain himself to everyone who wants to know and the man could have action taken against him and his job. I dont know how it all works in that process but I assume if you make major errors, action can/will be taken against you just like in any job in this world.

Unless you are Sasuke and Brycy and you make the office tea and coffee. You get that wrong and its just a clip around the ear and a new brew expected ;-)

Lots of noise about Bismarck who should have been suspended and got off way too lightly without any doubt. What nobody seem to worry about is the fact that Scarra Ntubeni also came off Scott-free from what was clearly a spear tackle.

If Bismaark is going to stand on players and bite them etc, he should limit the amount of times otherwise he will be suspended.
Maybe in the next All Blacks test he should do a Tyson style of bite on Carter, this will give the Kiwi fan boys something to really complain about instead of blaming Bismaark for Carter not even being able to take a soft tackle.

not so clever mike how brave of baboon bismark to stomp on a player that was lying flat on his back - you must be very proud...

...but they say he's the worlds best and undoubtedly so as it takes real skills to get away with stomping on a player with impunity not to mention attempting to break Messams windpipe and getting away withthat as well....then theres the history of eye gouging...Seems to be one rule for Bismark because he epitomises the ultimate Springbok warrior ( a dirty crazed braindead neanderthol lol) and another for everyone else...

....no doubt the judicial officer was paid handsomely in blood diamonds to hush it all up though so alls well that ends well...it all just reinforces what we've always known about SA.

It’s par for the course as far as I’m concerned.

He was done an injustice by the kiwis … who clearly are fearful of him and would much prefer him suspended … for life. Of course they’re gonna come aboard and whine about the “injustice” of it all.

That’s how they are. We all saw how they cheered when he was red carded. Any physical challenge to their so called sovereignty needs to be snuffed out as soon as possible. Makes me think of Mad Bob Mugabe in Zimbabwe.

Their hypocrisy knows no bounds … they have nothing to say about their own corrupted system favouring their players … giving their thugs carte blanch on the pitch.

They play by a different set of rules. Ask McCaw.

I’ve gotten used to their foot stomping tantrums and have accepted that they are no longer the nation I was raised to believe they were.

I’m delighted that Bismarck was acquitted of any foul play.

Long may he continue

There can be little doubt that the recurring nightmares my unfortunate friend brycy is having about Bissie is clouding his normally shakey judgement.
Bissie's stamping of labbbers was very mild and warranted at most a one week suspension. Anyhow glad he is playing as we want both sides to be at full strength.
I can only hope our officials are not being influenced by the kiwis and we will keep our high standards of ethical behaviour. Another briliant one eh brycy - we do our best to please!

Beeno

Have you gone jittery or lost your thinking abilities?   I gave Brycy the rap he deserved - but you have now spoilt it by unsubstantiated comments on the Bismarck incident.

Bismarck after being tackled by Labuschagne lost his cool and took a deliberate swipe at Labuschagne - which the latter warded off.   He got up and then deliberately stamped on Lapppes with force - not mild as you allege.

Secondly - if Rhodes can get a three week ban for an accidental incident in horrible weather conditions on a very slippery field on the basis that he had to be more careful - Bismarck should have gotten six weeks for two deliberate and needless actions as is clearly shown by the video evidence in his case.

It is wrong to justify a ridiculous decision as you did and you just give the NZ supporters further reasons to take a swipe at us.

I'm not sure why this Oosthuizen wanker has come to this ludicrous decision......maybe he was told from on high that Skidmark was required for the CC final and/or the EOYT but unless the SA administration steps in and appeals then it will show the world that rugby in that country is rotten to the core.SA is already infamous for it's filthy and cowardly play....this only confirms what we knew already. All SA supporters should hang their heads in shame today.
