That was a given. Would have been near impossible to prove he intentionally killed her. Negligent killing will be the verdict.

I did not follow the media circus - and did not know about the finding.   Said in the beginning they could cut the cost and find him guilty of manslaughter/homicide.

Culpable homicide = negligent killing....ie no intention or pre meditation to kill her.

It's the negligent killing of someone....This trial is about whether he killed his partner intentionally or not.
Yes he fired into a door with the intention or knowledge that his actions would cause harm.  But you can't prove that he knew his partner was behind the door and that he fired with the intention of killing her in particular.

Cloudy I do hope that they lock him up for a good long time. They might not be able to prove intent but for my money that is only based on the presumtion of innocence.

I thought the judge did a very sound and professional summing up...far better than you get in the USA and jury...a circus of human feeling and error. well done Thokozile Masipa.

Only he knows the real truth and the prosecution failed to prove beyond reasonable doubt...

If he's guilty he does not escape a higher judge as we all will...I only hope that he realises that and makes his peace somewhere into the future.

He still faces cupable homicide which is a very serious charge and could do time.

Given the circumstances it would have been near impossible to prove his intention to kill her was beyond reasonable doubt. The standard of proof is too high and the prosecution had little to work with.

It may well be your last time.Things is,you exposed yourself for the true character that you are.An individual that makes light humor of murder.Everyone that reads this will see you for who you are.I know I am no better then you.We all will one day answer for our wrong doings. So I am by no means placing myself upon a pedestal. But you can not with any sense of respect justify this blatant disrespectful slur to the Steenkamp family.Shame on you.

100% he should . I was listening to the judge summing up and she said something that just made me think "he's gonna walk" .The judge said not only would she discount angry texts between them but also the screams witnesses reported .And she said that the poor girl could have taken her phone into the toilet to use as a light ? Isnt that what light switches are for  ?

Dolus eventualis is a very subjective test. The state did not prove beyond reasonable doubt that he knew there was probably someone behind the door. The judge wasn't wrong per se, but 5 judges in the appeal court might and probably will see it differently. I suspect that if this case does go on appeal, it will be a split decision in any event, but most likely a reversal. Culpable homicide sometimes carry stronger sentences than murder, depending on the facts.
Wardad, I use my phone as light when going to the loo at night. I is not as blinding as switching the light on. Oscar will still face some serious jail time .

Yeah that light thingy  just made me think " oh oh the judge is discounting the prosecution points ,not good ' So does he get anything at all ? is there any chance of a retrial ? or does double jeopardy come into it ?

There are no grounds for a retrial, but both the defense and the prosecution can appeal the verdict. The appeal court has 5 Judges that will go through the facts again. No new evidence can be entered though. I predict a 5 to 15 year sentence, it might even be longer.

You remember that tart that was married to Andy Williams the singer ? Claudine Longet ? she murdered her boyfriend and got only a small fine 30 days in jail [ she not only picked which days but had her interior designer decorate her cell at the local jail !] and then went on holiday with her lawyer .Money and fame trumps justice no probs.

Anyone who has bullets such as those and fires four of them at someone in such close quarters, regardless of the circumstances, has a jolly good idea they are going to cause the death of the individual behind that closed door.
I'm afraid no Jury would have found him Not Guilty of Murder or the lesser charge he has been exonerated from. So much for the wonders of this type of Court !!
I can give you a list as long as your arm as to why he would not have been found Not Guilty of Murder.

As I have said many times throughout this boys career, he has many problems, and he has much I feel sympathy for.But to do that to someone is unforgivable and has to be punishable in the strongest terms.
It's a tragedy, quite honestly. But I do see the cynicism surrounding much of it.

I am not sure aboout this one.  The problem in SA is that intent to commit murder is a key element in legal processes dealing with Murder cases.   It was very difficult to prove that in the Pistorius case and that is what made the judge decide no to accept the cse of murder as suugeste dby the prosexution.
The next issue is the issue of culpable hoimicide and the judge already indicated he will dea; with that issue today.   From his rmea rks it is clear that Pistorius is likely to be convicted on the basis of culpable homicide.   That normally means a twlve year jail sentence - but what normally happened is that anybody guilty of culpable homicide gets paroled after sic years in prison.
so lets see what happens in this case.

The intent to commit murder wasn't there then, Mike ?
When he picked up a gun, went down the hall, to a locked, small toilet and fired four of the most disgusting and vile bullets on the planet, that are illegal, of course, and that he, as a very experienced gun owner knew ? He also aimed those bullets rather deliberately, did he not ?
He then decided to call a friend, not the emergency services. Hmmmm yep, the friend with the black bin liners ! That was a point many of us picked up on over here !!!
Oh and that is not withstanding the fact that most people, including himself, don't really believe his version of events, now do they ???
Using those bullets in a gun in a closed space alone is enough to convict him, in most peoples eyes.

CC one of the conditions for pre-medated murder is that you know EXACTLY who it is that you "intend" to kill. It's a huge loophole, and one that lawyers have exploited since forever. Hence all the controversy and much time spent by his defense trying to make us all believe that Oscar unlike any man on earth, does not know when a woman is beside him in bed.
My suggestion...Give Francois Hougard 15 minutes in a windowless room with that scumbag.

It can only be self defense when your life is in danger. Who was endangering Oscar's life? He never even saw a threat, he made one up in his mind (that is if you believe his bullsh!t story) .

Deliberate if you knew someone was in there ... and deliberate if you didn't know, but fired anyway ...

Either way the intent is clear enough for all to see. He pumped not 1 but 4 rounds through the door

Typical South African incompetence.

The judge looks to be just another quota pick. Affirmative action at it's worst.
