Question for the legal buffs.

Quotas are possible for provincial sports teams and our national teams due to their legal status. So here's my question. If a charity was formed and a sports team represented that charity but we're not paid by the charity, would it still be possible for quotas to be imposed on that team? Interesting side note for you non Saffas on this board. Currently in South Africa, if you were make a donation to a charity that looked after both white and black orphans, the government does not regard this contribution as suitable to assist your BEE status...because you donation benefits "some" white children. If however, you donate to a charity that benefits exclusively black children, then you're A Ok ;)

 plum - I am not sure about the issue of BEE - but there was a Supreme Court ruling that BEE cannot be used as a means to discriminate against White employees - so there is a problem here.   I am not sue that there will not be a case on that issue which may not end up in the Constitutional Court on the issue in the long run.   The case is that rugby players are in fact contract employees of SARU or its affiliates.   However, there is another problem as well and that is that foreign Clubs rarely contract players of Colour from SA - which raises another question - are such players in fact of competence to allow for foreign contracts.  Of the hundreds of SA players with foreign contracts I can only think of Mujati, Aplon, Habana, Kirchner and Pietersen - who represented the Springboks and got contracts for playing for NH clubs.  There may be others - but I think the general rule is that it still is a very small percentage of the SA players playing for foreign clubs.

I'm just wondering because if players salaries could come via sponsorship deals as opposed to the cheques being signed by SARU and co, and these players played for teams under a charity banner, it could be a way to circumvent quotas. Right? Players can't be forced to play for provincial teams. And i don't think SANZAR would put up with all the best SA players playing abroad or in a private charity league locally. Haha, it'd be great kick in the balls for the ANC, SANZAR and the IRB(itches) Obviously it will never happen.
