The following from News24:-


"Reds prop Taniela Tupou has escaped punishment following his tackle on Stormers wing Craig Barry during their Super Rugby match last weekend.

Tupou was cited after the match at Newlands but a SANZAAR disciplinary committee on Wednesday determined that the player’s action did not warrant a red card.

Replays of the incident appeared to indicate that Tupou’s tackle was late, high and that he used no arms.

However, SANZAAR came to the conclusion that the incident did not breach the red card threshold.

The decision was in direct contrast to the views of respected SuperSport analysts Nick Mallett and Naas Botha who said immediately after the match:

"I do not know how this foul went unpunished. It was impossible for all four (referee, two assistant referees and the television match official) to miss it," Mallett said.

"It was a clear-cut red. There was no argument. It was a straight-forward decision. Red card," Botha believed.

A SANZAAR judicial committee hearing determined that Tupou contravened Law 9.11 - Players must not do anything that is reckless or dangerous to others.
 
But Tupou was issued only a warning under Rule 8.5 of the SANZAAR disciplinary rules.
 
“A warning can be issued for acts of foul play that are viewed by the committee to come close to but do not warrant the player receiving a red card,” SANZAAR stated via a press release.
 
The SANZAAR judicial hearing panel, held via video conference on Tuesday, consisted of Robert Stelzner SC (chairperson), Mike Mika and David Croft.
 
In the finding handed down by Stelzner, the committee ruled the following:
 
"Having conducted a detailed review of the citing commissioner’s report and all the available evidence, including all camera angles and additional evidence, consisting of a written statement from the player’s opponent, Craig Barry, and from the Stormers’ physician, oral evidence from the player himself and the submissions from his legal representative, Mark Martin QC, the judicial committee concluded that the level of offending did not breach the red card threshold yet warranted a warning under the above rule.
 
"The judicial committee concluded that the player, whilst attempting to use his arms, failed to properly grasp his opponent in the tackle, which resulted in the point of contact being between the player’s right shoulder and his opponent’s upper chest area, causing the opponent to bounce off the player. An inadequate attempt to grasp his opponent immediately before the point of impact resulted in the action being reckless as to the consequences thereof.  This was in contravention of Law 9.11, and close to, but not crossing, the red card threshold. As a result the judicial committee issued the player with a warning.

"The player is therefore free to play."


This is crazy and a recipe for disaster.   Somebody should appeal that decision - since it is clearly a serious case of dereliction of duty by the hearing,

I think you Yarpies blew that incident totally out of proportion. The citing panel got it spot on. No way Tupou deserved a red card or a ban for that.
Looking forward to watching the mighty Blues thump the useless Sharkies this weekend.

this is pure BS,.... replays of the incident show exactly the opposite,... the tackle wasn't late,.... the stompies player run against Tupou,... is the stompes player the one who runs agaist Tupou and throws the pass just before the contact,.... this can never be a late tackle,... happens thousand of times,... the guy who wrote this have never watched a game of rugby,.... or is as biased as the yarpies here

wasn't high either,... the contact is at the stompies chest,... that's not high,... never has been

and the reds players did use his arm,... it's very clearly seen in the video, just after the contact, the reds player has his arm totally extended,... you can watch it here:

Two steps after the ball is passed to contact....so it was borderline late. We can't see the tackler's right side. But we can see his left where the arm is down and in. What we also can see is the tackler's right arm does not extend beyond the passer's body before the hit....if it's wrapping round we should see it. We only see the tacklers arms when he pushes off the tackled player....another clear indication he wasn't trying to tackle he was trying to hit. Legitimate tacklers don't push off. The hit was high on the chest sliding under the head and snapping it back.....there was far more torque in that hit than the neck roll so beloved by some TMOs. Taken altogether it was late, not intended to be a tackle, making contact with the head, without any semblance of arms being wrapped and dangerous. It was a red card offence.

And hes not one of ours now is he ? If it were the other way round in that tackle I would think the same and past history has no bearing on this particular incident .

I don't think it was even that bad. Yellow card at best. Seen worser. Huge guy on small guy. Looks lik a big tackle on a small guy, and he was falling. Bit late, and a bit high. Just looked like a poor tackling technique if anything. I have seen Tupou in a few other games he seems to tackle in the fashion of running at people lik a train. But please enough with a double standards. We know SA players have got away with a few things over the years.

the following is the secuence of the hit frame to frame,... the quality is quite poor but that's what it was the video uploaded by Rugby365,... in the first frame the stompies player, Barry, is still with the ball in hand:


the nest frame shows Barry throwing the pass,... the ball leaves his hand,.. his left foot is already on the ground

and the hit,... his left foot still in the same place,... no step at all :




where are the 2 steps? there's no step at all,... Barry throw the ball and then comes the hit,... this is called to fix a defender (it's the literal translation from spanish but I think it's correct in English),... never can be a late tackle,... happens thousands of times

where his left arm is, means nothing at all,... the hit is with the defender's right side

there's no need at all,... according to law 9.16 related to dangerous play, "A player must not charge or knock down an opponent carrying the ball without attempting to grasp that player",... four frames after the hit begins (which correspond to 16 hundreths of a second) Tupou's arm is very clearly seen (if this site would allow to upload videos) completely extended,.... this means that he made the movement of grasping the player (even if he didn't grasp him, all that is needed is the attemp)

Taken altogether it wasn't late, making no contact at all with the head, with the right arm accompanying the movement.

Wrong I freeze the frame......the ball is in the air visible behind the player's right hip......that's one step. The passer is on his left foot one step into the Reds half. And the players' bodies are still a step apart, not even the tacklers outstretched arm has reached the defender. That's two steps.....he hit the passer when the ball was well clear. You can say he was committed, you can say he was clumsy......it was dangerous, made contact with the head. Itshould have been a red card. Case closed.

when the stompies player throw the ball he has his left foot on the ground and before his right one,... to take a step he should put his right foot before the left one (right? or are you going to discuss this also?),... when the hit happens, Barry has still his right foot well behind his left one,.... in fact it's almost in the same position because since the player throw the ball till the hit there are only 3 frames which means 12 hundreths of a second,... it's impossible to take 2 steps in 12 hundreths of a second,....

the fastests men in the world need around 40 steps (bolton,e.g.in the following video: https://www.youtube.com/watch?v=4gUW1JikaxQ) to run 100 m. in 10 seconds (or in this case 9.80 secs),.... the fastest man on earth needs around 0.5 secs to take 2 steps so can you explain how the stompies player can take 2 steps in 0.12 secs?

there's no step at all, didn't hit the head at all, the disciplinary comitee after watching all the angles and watched them properly established that shouldn't be a red,.... and rightly so.

Rubbish.....the ball is clearly visible behind the passers hip BEFORE the tackler makes contact, when their bodies are still a clear step apart. The ball has already travelled some distance at that point. That is the closest freeze point....at least one step for the ball having travelled some distance .. ..another step because their bodies are a step apart. 1+1=2 Stop lying

that never happens in the time since Barry throws the ball and the hit,.... the legs are in the same positon,... it's impossible to take a step if you don't move your legs,... no matter the distance, no matter any other issue,.... if you don't move your legs there's no possible step

It was contentious but the benefit of the doubt will have to go to the Reds player because it is hard to determine malicious intent.  ie. Was it premeditated to shoulder/head charge, or was it just a reaction to protect his own face and head in the tackle. A yellow would probably suffice for reckless dangerous play, however, if a yellow was not awarded that would have also been fine. These type of collisions happen in games because the opponent has changed his relative position to the tackler, or the tackler slips while tackling etc, etc.

Actually to close a gap you have to take a step...and a ball takes time to cover distance.....time equals steps.....it's that simple. But let me help. Go to your video, pause it at the hit....then gently slide backwards to the point the passer is straddling the halfway line. The ball is leaving/has left his hand depending on the micro second you stop. The Reds tackler is still two paces away. I'm not saying two paces when players are closing is massively late....I'm saying it's marginally late. Three paces would be clearly late. But I am saying the passer was signalling the pass, and the tackler went through with the tackle full out and....marginally late. He then tackled up.....from low to high. His first contact may have been on the chest, but his whole momentum was up. He is on his toes by the time the 'tackle' is made. And his whole momentum goes through the receivers head region, snapping his head back. It was a dangerous, clumsy and marginally late tackle which could have caused serious damage,

I have to correct myself here. I have now seen a better close up view of this incident and they were only one step apart when the tackled player offloaded. My apologies to Basque. That footage, however, also gives a clearer view of contact....which was to the upper chest and under the chin. The tackler drives up, straightening his legs. There is no evidence of any effective use of the arms. For me this tackle was meant to injure the player and is the worst example I have seen this year.
