Either Folau or CEO will go after sacking call 


Israel Folau will challenge his sacking over a homophobic social media outburst, Rugby Australia confirmed on Wednesday, creating a scenario that could claim the scalp of RA chief executive Raelene Castle.

Folau was given 48 hours to either accept the termination of his $4 million contract or request a code of conduct hearing, and has opted for the latter.

It has been reported that Folau will argue that Rugby Australia did not put specific social media clauses in his new deal, signed in February, and that he did not deliberately vilify any individual; that he was just quoting the bible.

The Wallabies star has chosen to fight his termination

despite condemnation at all levels of the game, including a declaration from Test coach Michael Cheika that he would not select the fullback. In a bizarre worst-case scenario, Folau could become a $1 million per season park footballer.

"Israel has responded formally today to request a Code of Conduct hearing which, under the circumstances, was not an unexpected outcome. We will now work to confirm a date for the hearing as soon as possible," Castle said in a statement.

"After the date for the hearing is confirmed Rugby Australia and the NSW Rugby Union will make no further comment on the matter until the Code of Conduct process has concluded."

DECISION WILL FINISH EITHER FOLAU OR CASTLE

Either Folau or Castle will be finished in Australian rugby after the attempted sacking of the Wallabies star is over, former Test player Peter FitzSimons says.

Folau said in an Instagram outburst last week that gays would go to hell. He also attacked transsexual people in a Twitter post.

Castle said that she had repeatedly warned Folau about vilifying LGBTIQ people after a near-identical social media incident last year. She said that Folau had breached his contract by again attacking sexual minorities.

Yet it has now been reported that there is no specific condition in Folau's contract prohibiting him from airing discriminatory views in the name of preaching his religion.

"At the end of the day, either Israel Folau will stay standing or Raelene Castle will stay standing," FitzSimons said on Five Minutes with Fitzy.

"She's the CEO of the whole operation. If by some extraordinary legal manoeuvre he survives this ... given what happened last year, the disaster that ran for three weeks, and you signed him up again for $4 million and it wasn't legally locked down that he can't do this, then you've got to go.

"If we take Raelene Castle at her word, and I have no reason not to take her at her word, she said they sat him down, he signed a standard contract but there were addendums, there were things that absolutely, legally made it clear - as we understand it - that you can't do this stuff again."

Yet a News Corp report claims that only after Folau re-signed with Rugby Australia for another four years did officials try to have social media clauses inserted in his deal.

Folau refused to go back on the initial agreement and Rugby Australia had no choice but to submit, meaning specific conditions are not in his contract.

The lack of a social media clause will play a huge role Folau’s defence and will call into question the re-signing process put in place by Castle.

The case could set a precedent in Australian sport and workplace law. It seems that the terms of Folau's contract, which would contain a standard legal address of discrimination issues rather than language tailored to his specific case, will be tested.

If Folau wins the case, lawyers say other Rugby Australia employees who are offended by his posts could also take action.

An absurd worst-case scenario looms if Folau somehow manages to remain in rugby: that he plays park football or remains inactive while being paid $1 million per season, given that the Waratahs and Wallabies have indicated that he will not be selected.

Or, that he is simply paid-out the remainder of his contract.

"Given what has happened, that [exclusion from elite rugby] will be the only possibility," FitzSimons said.

"Given how strong Michael Cheika was for the Wallabies, [NSW captain] Nick Phipps for the Waratahs ... you can't run out with the Wallabies anymore, that's done. And you can't run out with the Waratahs anymore, that's done."

FitzSimons believes that Folau has breached basic workplace legalities by condemning LGBTIQ people.

"This is not simply a matter of religious freedom," he said. "No, it comes down the workplace law.

"Given that he agreed not to do the posts again, if we take Raelene Castle at her word, there's nowhere to go. He has to go."

FitzSimons said that Folau, for all his talent, would be quickly replaced by the Wallabies - who will play in the Rugby World Cup later this year.

"There's always people that go and everybody always thinks that there's nobody that can possibly replace them," he said.

"It's extraordinary how people come along along and they're quickly replaced. Against that, Israel Folau is a serious loss because he's seriously good player."

They messed up not getting him to agree in writing within the contract that he would condemn people to hell on social media - especially as he was getting a pay upgrade. 
However, common law still applies even if something has not been explicitly agreed in writing. 
If someone was in the workplace sending emails around of a list of all the people at the workplace that are going to hell - it would not be acceptable. 
An Arab's religion is that everyone should convert to Islam or die here on earth. Is this freedom of speech. 

As a national sportsperson, he represents the country. Most of the countries are on his list of going to hell.  
If his belief's are the Tooth fairy or Dumbo the Flying Elephant, this praat is saying he is better than everyone else. Why does he have the need to say this?  Anyone can read the Bible, even a 5 young kid or a simpleton.

How people quickly cheapen their hard core beliefs. This man was born in the wrong country, with the wrong skin colour. Give him SA honourary citizen and a bowl of rice powder, he will fit in the so called quota policy mantra in a blink.

A few days ago, he claimed that he would choose his god over rugby. And here he is, disputing his sacking.

The list he sent included liars.

It could be argued he did not lie, he could do without rugby, making him going after the money, the lust for money, the money idol, mamon. The list included idolators.

Seldom missed, fully so called westernized guy: always think of others when condemning. And so quick to show the behaviour they blame on others.

His lack of defence is on par: simply quoting a text is bearable when you do not understand it, not when you profess. Those are his beliefs as they are Bible's beliefs. They represent him as much as they represent the Bible.

As to not writing down which social networks, required. Social networks are launched regularly and a list can not be forewritten.


One week or so. One could tell he took him longer to betray than it took Peter to betray Jesus.

Billy Vunipola has been given a "formal warning" by the Rugby Football Union after the England player defended Israel Folau's social media post claiming "hell awaits" gay people.

The 26-year-old number eight liked the post by Folau and called for people to "live their lives how God intended".

Vunipola, who has also been warned by his club Saracens, has been "reminded of his responsibilities" by the RFU.

During a meeting, the RFU said Vunipola had "expressed genuine regret".

"The warning will be retained on his disciplinary record for a period of five years and may be taken into account in future disciplinary proceedings," the RFU said in a statement.

"During the meeting the player expressed genuine regret at his public comments and understood that he had caused hurt and offence as a result of his actions.

"He has been reminded of his responsibilities as an England player and as an ambassador for the game, which values inclusivity and respect."

Vunipola released his own statement on Monday saying he had not intended to "cause suffering".

"I can see that my recent post has hurt people," said the Sarries forward. "My intention was to express my belief in the word of God.

"These beliefs are a source of great strength, comfort and guidance in my life. Anyone who knows me, knows I live with kindness and love towards ALL people."

Folau's contract was terminated by Rugby Australia because of a "high-level breach" of his code of conduct.

Vunipola is set to feature for Saracens in their European Champions Cup semi-final against Munster on Saturday as the English champions aim to reach a fourth final in six years.

Sarries director of rugby Mark McCall said the controversy has been "a distraction", and is "thankful the club and RFU have acted quickly".

"He's obviously had a challenging few days," McCall told BBC Sport.

"As a team we see the matter as having been dealt with and we want to talk about the rugby and concentrate on the rugby."

Spot on. People grow frustrated with their own delusions. As there is no hell, they try to make it true by themselves. They bring hell to others in an attempt to give actuality to their delusions.


Knowing there is no hell does not change anything.

When a gun person claims they will kill people by lodging a bullet in each of their eyes, knowing it is not possible changes nothing.


This guy posted a message promising bad outcomes to people. He urged them to follow his ways.

This guy has no will to help people he considers deviants. Dropping a message like that on a social network helps much less people than it does not help. Helping people means working with them and understanding them.

He is not even informative as he forces people in a certain way. Other religions too condemns the behaviours he quoted and they are also a way of being saved.

Nope, people must repent and believe in his god.
