I would dearly love a comment from our friends on site who promote the Biden Administration to deal with the following:-
Early on during the Pandemic it was found that there are in the vicinity of crca 1,5 million families living in rented homes and flats that would not be able to pay rental since they lost their income source as a result of Covid. The CDC then decided that the problem could be solved by banning property owners from evicting anybody who did not pay rentals. This was done departmentally and included in a proclamation of the issue by the CDC. The original approval by the CDC was for three months – but was constantly renewed by the CDC.
The problem was that the middle class people decided that they want to try and augment their retirement income by buying a house or flat to lease out . In the main they had to pay off their own him loans for the property they live in and in most cases use home loans to by the rent-out-to-be properties and to cover costs such as repayment of loans , maintenance of properties and payment of rates and taxes iro the rent-out properties. The COD grants started and being aware that they could be evicted they just stop paying rentals altogether and the owners of the rental properties suffered badly through financial losses.
As expected the matter ended up in the Supreme Court after a High Court ruling that confirmed that the CDC has no right to make a ruling stopping evictions from leased properties, The Supreme court was split on the issue with four judges deciding that the matter was in total contradiction of the constitution – but even though they agree as to the unconstitutional failure – they support Judge Kavanaugh proposal as how the legislative Branch could solve the problem and to give them a chance to deal with the issue on a legal basis. In writing the decision Kavenaugh tried to help to legally protect the interests of both the occupiers and the owners by legal means. The final decision was that since Congress was the only institution that could decide on the issue, the Supreme Court ruled that Congress should pass the necessary legislation before the end of July 2021 – the ruling was made on 29 June 2021 and the expiry date of the eviction proclamation was to be on 31 July 2021. \
Although the time frame was limited neither the Biden Administration , nor Nancy Pelosi as Speaker and Senator Schumer did nothing about the needed legislation. To be constitutional the legislation would have to be compensated for their losses and especially iro those who could lose their properties as a result of Government action. Be it as it may – the Democrats in charge d id nothing about the issue,
The day before expiry of the ban on evictions Biden stepped in and overruled the Supreme Court ruling by extending the eviction moratorium and now the State faced damage claims from the property owners running into billions of dollars.
Now my questions to especially Rooinek, SB and others are the following:-
* Was the CDC in fact acting according to the Constitution by implementing the prohibition of home owners to implement eviction for non-payment of rentals during the covid emergency?
* Was the Congress right to ignore the Supreme Court ruling and not passing the required legislation?
* Does Biden have the right to veto or ignore Supreme Court Rulings on this particular issue?
*
Bearing in mind the constitutionality was Biden not acting contrary to
the oath he swore and was his actions thus a real impeachable offence?
