I dont think the image is clear.
He may or maynot have this mouth around the arm- or the arm might just be blocking his Face- but does not appear as close as possibale.
They will need proof from the person that was suposedly

It looks like a bite, but it could incidental contact. Without the video images it's hard to reach a conclusion. My guess is, if this is all they have Malherbe will beat the rap.
