Cape Town - Former South African Test referee Jonathan Kaplan has sympathised with Craig Joubert, who has copped heavy criticism for his handling of Sunday’s Rugby World Cup quarter-final between Australia and Scotland at Twickenham.

Joubert's decision to award Australia a match-winning penalty for off-sides in the 79th minute gave the Wallabies a narrow 35-34 victory.

World Rugby on Monday night released a statement confirming that Joubert’s decision was wrong and that he should have awarded a scrum to Australia instead.

Kaplan commented on the incident via his website, www.ratetheref.co.za.

Kaplan believes the decision to award the penalty would remain a point of debate depending on how one viewed the incident in question, but did question why Joubert opted to award a penalty if it wasn’t ‘clear and obvious’.

“Joubert blew for Scottish prop Jon Welsh being off-side ahead of the last ‘Scotsman’ to play the ball, Josh Strauss. What happened between these two acts is what seems to have incensed a large portion of the Scottish rugby public and perhaps the neutrals looking for the upset,” Kaplan wrote.(Eg Dr Mozzzz)

If the ball touches a player (Nick Phipps) and he doesn’t play it, it is not enough for the sanction of a penalty to change. And so, this whole review revolves around whether you think Phipps intentionally played/touched the ball, when trying to catch it, or whether it merely bounced off him.

“This is the crux of the matter. Did Phipps get a hand to the ball, or did he get a finger on it? There are people on both sides of the fence, and those still sitting on that fence. This is not a luxury that Joubert had at his disposal. He had to make a decision in real time. It is not an easy decision, even in slomo."

However, Kaplan suggested Joubert should have erred on the side of caution if he was in doubt.

“The only thing I will say is that generally referees are told to only blow for the clear and obvious and in this particular case I would hazard a guess that there could have been doubt.” 

Kaplan was reluctant to speculate on why Joubert hurried from the field at the final whistle, but did admit that the decision to yellow-card Scotland wing Sean Maitland early in the second half for a deliberate knock-on was ‘harsh’.

Kaplan said nothing about the use of the TMO because there's no debate and nothing to discuss. It's all quite clear.

Refs have to apply the laws of the game and the laws do not allow for a TMO to be used in an incident like the one above where there was no foul play and no try involved.

rooitwit there was talk of a RWC protocol being put in place whereby incidents like these would not be referred. H ence your comment looks to be incorrect.

Quite apart from the fact that you're blathering on about some unsubstantiated "there was talk blah blah" nonsense, you then go on to talk about an alleged "protocol being put in place whereby incidents like these would not be referred."

Would not be referred? Isn't that exactly what I'm saying, chump?

Indeed, Baboon-ou is too stupid to know that he's actually agreeing with me.

The laws regarding what the TMO may be called for are very clear and I'm not aware of any temporary change to these laws for the duration of RWC2015.

 The bottom line is that Joubert made a wrong call.
With perhaps the biggest TV rugby audience watching the game and at the largest rugby stadium plus in a quarter final of the rugby WC you cannot afford to screw-up and make a wrong call.
Unfortunately he did.
Also because of his wrong call the team that should of won the game has been knocked out of the WC and the losers are going to the WC semi final.
Joubert is a top ref according to the WC officials and gets paid excellent money to ref. So if he is unsure and as in this case his decision would result in the team being awarded the penalty could CHANGE THE RESULT and win the game he should have called a time-out and consulted with the touch refs and even gone to the TMO for confirmation.
Instead he made a call that was wrong, stuck with his call and then ran off the field which is not the custom after the game.
A few people had made excuses of him such as  running off the field to avoid any incidents but in my humble opinion he ran off the field because he knew he had screwed up and was not man enough to face the team or the crowd for his mistake.
There is no excuse for his blunder......
In my opinion he should be banned from reffing any international rugby games forthwith. Go back to his banking job.
Currie Cup rugby is about the highest level he should ref at.
