The slimy git gets less than a year before being released to serve the remainder of his sentence in the harsh environs of his Onkels mansion .

Even if you acceptr his nonsense story that he thought he was shooting someone else all it means is he deliberately killed what he thought was another person IE:MURDER .

The poor wee little man...

Well.... to the average layman, shooting that many bullets through a door is not normally done just to scare someone off

 So what would you say then Saffex ?The poor wee lad tried to defend himself by shooting several times through a door ? Even if it were not that poor girl he could have called the cops and kept the "intruder" bailed up .But any reasonable person not trying to be contrary for the sake of it would surmise that on the available evidence and given this pricks unhinged behaviour , the little swine knew damn well what he was doing when he shot her.That pommy writer was right about lawyers and what to do with them .Well the Johnny Cochrane style lawyers anyway.

As a layman, the most damning thing for me was that the first bullet didn't kill her and apparently hit her in the arm.


Anyone would think that she would have instinctively screamed with pain.....are we to believe he didn't recognize her voice?

 Any git that would fire a gun for a laugh in a crowded restauant ,in this day and age ,is more than capable of using a gun on another person out of rage .It shows the mindset of an overindulged barely adolescent little boy.Who would not countenance one of his posessions being taken from him ,and was going to make damn sure of it .

Dave, he shot through a door with the intent to kill (unless you think 4 dum-dum bullets signify some intent other than killing) whoever was behind it. If that's not murder, kindly explain what it is. Self-defence doesn't wash - he was never in danger. There was no threat.

This spoilt man went off the rails when he he was beaten in the Olympic games by the Brazilian kid.....couldn't say one nice thing about him, totally lost control. The system protected him, as it has done in this instance. The house arrest stinks to high heaven.

I saw Oscar run in the Olympics themselves. The stadium adored him....the support almost lifted one off your seat. Then that moment in the T44. It was the time for him to embrace the kid, to tell the world another great handicapped athlete had emerged....to play his role as a pioneer of handicapped running. Instead he became a whiner.

Best leave it to the professionals then.......for all that layman stuff sounds great but carries stuff all weight.....they had to prove he intended to murder her, motive and all that......there was no evidence to support any of that......hence the verdict.


You cant convict someone of murder when there is no material evidence to prove it......getting all emotional about when, why and what for......stands for nothing

Um, there is no evidence to prove his intention to kill his girlfriend, nor was any motive brought to light in this regard.....we can speculate all we like but without material evidence to back up your speculations, you cant prove murder......the only verdict possible was negligence.

When someone fires 4 hollow point bullets through a wooden toilet door, despite the fact that they are not checking who is behind that door in the first place, their intention is to kill whoever is behind that door.... period.

 

I cannot fathom any other reason for any individual to do that, and not expect to find a dead person behind that door.

Is a specific offence in various jurisdictions within the Commonwealth of Nations which involves the illegal killing of a person either with or without an intention to kill depending upon how a particular jurisdiction has defined the offence.

 

They got the penalty technically correct, I believe it should have been murder, but my issue is not with the penalty, it is with the time imposed on him to go with that penalty.

You can only prove intention to kill someone with a gun if you aim at that person and shoot them to kill them......not possible when shooting through a door.

I am with you on this one and that was my opinion right when his bail hearing started. I am not defending him or what he did but at this stage, if you look at it very clinically, the only one who really knows if there was any intention to murder her is Oscar Pistorius himself. There is no way that anyone else can know, without any substantial evidence, that this was a planned murder.

I can remember watching that race and having the exact same thoughts. However, in the week or two after the race, they had a discussion on that on the One Show on BBC. Their studio guest was actually the guy who made the prosthesis's for both Oscar and the Brazilian lad who beat him. I listened carefully what he had to say and he actually sided with Oscar.

The reason was this. Oscar had this "fight" to compete against the able bodied athletes for a long time and the PTB was convinced that his prosthesis gave him an unfair advantage because of the "spring action" of the blades. What they did not take into account, or rather refused to take into account, was the fact that - while there could be some degree of merit in their argument - he had another disadvantage in that he did not have an ankle joint.

Be that as it may, the IOC eventually agreed that he could complete in the Olympics but then they turned around and, in their wisdom, decided that he would then only be allowed to compete in the Paralympics if he used the same blades that he used in the Olympics.

He was therefore not allowed to compete in the Paralympics on level grounds with the rest of the athletes who were using the latest technology. He (the guy who makes the blades) was asked about Oscar's remark that some of the guys, including the Brazilian, was almost a foot taller than he was the last time the raced together. He confirmed that it was 100% correct. They have increased the length of the blades in the last 12 months prior to the 2012 Olympics, but because of the sanction by the the IOC, Oscar could not make use of those and that the Brazilian was in fact about 20 cm (IIRC) taller than when he use his "normal" legs.

That was why Oscar was upset. He just chose the wrong platform to voice his opinion.

Innocent until proven guilty beyond any reasonable doubt. This is the underlying tenant of democratic law, without which the legal system would be a farce. 
If he never murdered her on purpose, then it must have been a mistake. So he is innocent of murder, but guilty of involuntary manslaughter
If he had genuinely thought it was an intruder- he may well be within his rights to shoot the person out of self defense. He could have been half a sleep and without his wits when he fired the shots.

Spot on Shark and Vlag - given the facts of the case there was no way of proving intention, without which then can be no murder.


The fact that he had no legs and the incident happened in a crime ridden country are factors which would have contributed to the actions he took. He is obviously more vulnerable than a person with legs.


I am not defending his actions, merely stating the facts

What a subject on a rugby forum...the only one that makes sense said ...So you can prove he murdered her then?

What I think is irrelevant but I could be right...he was just a sicko with hidden psycho problems but certainly ,if you understand psychology, not a planned murder... just an unbalanced personality...he needed to be put away with treatment... but really what he did can only be treated with repentance and honesty and to fix his life....it should be very tough on him and he must take responsibility...an awful thing but can never repay...only true admission before his Creator and true repentance and a changed life can restore...at least as far as human beings can go...Sa ffex is right, cannot be proved, his only problem (which is huge) is dealing with God, I only hope that he has the guts and honesty to do this.

Interesting post Vlag. As far as the verdict is concerned this case is about on a par with the OJ Simpson case....a miscarriage of justice. Perhaps it isn't a provable murder, but the truth is there to see.

 

 

So one reluctantly accepts the manslaughter verdict, but to then bend over backwards to release the murderer from jail into house arrest because of "good behaviour" is sicken ing.

I said they "technically" got the penalty correct, even though "I" believe it was murder, which I do.  I did not say it could be proven as murder, I said what "I" believe it was, as I suspect many people believe, even if it cannot be proven.

 

When I look over the facts of the case, along with his history of diabolical actions, that is genuinely what "I" believe, as I am entitled to.  Irrespective of what can be proven in a court of law.

 

I stated above that my issue is not with the penalty, but with the time they imposed with that penalty, meaning the pathetic 10 months, and now he gets to relax in his uncle's mansion.

 

Read what I said carefully before passing comments

We all know the legal system in this country is a crock! The one thing any sane person would do if they happened to be up late at night and they heard a noise in the toilet, would be to think it was the other person that is in the house with them. If said sane person had any doubts, they would call out to make sure of identity of the toilet's occupant, because a pistol with hollow point bullets in it, would offer sufficient back up should the occupant's reply be unsatisfactory.
He shot her, knowing full well who was behind the door! And he intended to kill!

I have met Pistorius and witnessed his arrogance, and a close friend of mine has also tasted his arrogance and gun threats! He is a bad tempered little pr!ck that deserves every curve ball life has thrown at him!

It is clear that law is much too complex for you to comprehend.

(1) It does not have to be premeditated.

(2) It does not have to be directed at a specific individual... He only had to foresee the possibility of the death of, or the serious bodily harm caused to another person by his voluntary act.

(2) Motive is not an element of any given crime. Only the elements of the crime need to be proven.

Best leave it to the professionals!!!
